DIRECT EXAMINATION

52:48:43

BY MR. WATERS:

62:48:46

MR. WATERS: Mr. Crosby, how are you?

72:48:52

RONNIE CROSBY: I'm okay.

82:48:55

MR. WATERS: All right. Tell the Court what your profession is and where you work.

92:49:04

RONNIE CROSBY: I am an attorney practicing law with the Parker Law Group.

102:49:07

MR. WATERS: And are you a former law partner of the defendant, Alex Murdaugh?

112:49:12
122:49:12

MR. WATERS: Do you see him in the courtroom here?

132:49:15
142:49:17

MR. WATERS: Where is he sitting?

152:49:19

RONNIE CROSBY: He is sitting between Mr. Griffin and Mr. Harpootlian at the defense table.

162:49:25

MR. WATERS: On -- and, again, this is an in-camera hearing so you understand I'm not exploring everything that might, depending on the judge's ruling, be before a jury, but I do want to explore a particular meeting. Were you present for a meeting with -- in which the defendant spoke on June 10, 2021?

172:49:46
182:49:47

MR. WATERS: All right, and at this particular meeting, can you tell the Court who all was present?

192:49:57

RONNIE CROSBY: I'm not going to swear that I don't miss somebody because it was a fluid event. My recollection is it would have been late morning, midday that we gathered at Alex's brother John Marvin's place, which is not very far from Almeda that y'all have been talking about, and I know I had been by to see Mr. Randolph that morning. There was going to be a meeting with law enforcement. They had given Alex a couple of days before they were meeting with him, and so we gathered there. I was present, Mark Ball was present, Lee Cope was present, John Marvin was present. At some point I believe -- and I don't remember exactly when Buster arrived. Jim Griffin arrived at some point, and I want to say Cory Fleming was there, and there could have been others.

202:51:09

MR. WATERS: All right. While that group of people were assembled, did the defendant -- and I don't want to get into the content, but did the defendant make any statements about what had happened on the night of June 7, 2021?

212:51:24

RONNIE CROSBY: He did. We were there as friends. We had been with him every -- starting the night of the murders every day and we were there for support. And he went over the events of that afternoon, or that evening, starting from the time he got home from work until the discovery of Paul and Maggie.

222:51:52

MR. WATERS: Where was this discussion taking place? Was it inside? Outside?

232:51:56

RONNIE CROSBY: We were in John's house there, I guess -- I don't know if he calls it a house or a hunting lodge but we were inside largely. I mean, there was some in and out of the house as well, but the majority, we were all sitting in a room together, and I was doing more listening than talking.

242:52:18

MR. WATERS: And were these -- the statements being made by the defendant, were they being made quietly to his counsel, or were they being made openly to all of the people in the room?

252:52:30

RONNIE CROSBY: Well, the statements that I heard obviously were being for me to hear them. I was not overhearing a conversation that was private between Mr. Griffin and Mr. Murdaugh. They did have some private conversations that the rest of us were not privy to, but -- so, there's a mixture of that.

262:52:53

MR. WATERS: But there were private conversations that you don't know what they were because you weren't privy to those, correct?

272:52:57

RONNIE CROSBY: Correct, and this was before, I believe, the South Carolina Law Enforcement Division agents arrived at this location.

282:53:08

MR. WATERS: To be clear for the Court, you did at other times aside from this meeting or this discussion have conversations with Alex about his activities the night of June 7, 2021, that were outside of this. Is that correct?

292:53:21

RONNIE CROSBY: That's correct. I mean, obviously we all were in shock but also wanted to try to find out what all had went on because we -- you know, as we got past that night of June 7th and the morning of June 8th, we're all, you know, trying to help find out what had happened and, you know, who may have been a potential suspect.

302:53:53

MR. WATERS: But in this investigation and in preparation, you were instructed to stay away from those -- from that meeting as opposed to the other ones that weren't in that meeting out of an abundance of caution until we could get guidance from the Court as to whether or not those in any way were protected. Is that correct?

312:54:11

RONNIE CROSBY: That's correct. I mean, I -- we had multiple conversations, as you might expect, all of us in a group, and there may have been pieces and parts, but what you and I have discussed up until now have been outside of what was discussed on June 10th at John Marvin's house.

322:54:31

MR. WATERS: Your Honor, I believe I don't have anything further for the purposes of this matter.

332:54:37

JUDGE NEWMAN: Anything further?

342:54:39

MR. GRIFFIN: Yeah. May it please the Court?

352:54:42

CROSS-EXAMINATION

362:54:43

BY MR. GRIFFIN:

372:54:44

MR. GRIFFIN: Mr. Crosby, I believe Danny Henderson was also there?

382:54:48

RONNIE CROSBY: Yeah. I told you I might miss one, but was Danny was there? I don't think Danny was there at first, but he ultimately arrived.

392:54:59

MR. GRIFFIN: And the meeting had been scheduled so that Alex and others, his brother Randy, for one, and John Marvin and Buster could be interviewed by SLED. Is that correct?

402:55:17

RONNIE CROSBY: That's correct. The purpose was to -- that SLED scheduled a time, and I don't know who scheduled it with them. And you're correct, Randy was there. And it was essentially going over the timeline of the evening of the 7th because knowing that Alex was going to be interviewed and, I think, Buster was and maybe Randy and John Marvin, over the course of that afternoon.

412:55:45

MR. GRIFFIN: Now, you were not scheduled to be interviewed, correct?

422:55:47

RONNIE CROSBY: I was not scheduled to be interviewed. And, Jim, now that you speak of it, I do think that while Mr. Randolph did not come into the meeting, he and whoever brought him over did come by -- there were two that I had forgotten -- and then went back to Almeda.

432:56:04

MR. GRIFFIN: Where he died within hours of that, right?

442:56:08

RONNIE CROSBY: He died as we were leaving or right after we left this meeting with law enforcement. We were on our way back to -- and Randy got a call.

452:56:21

MR. GRIFFIN: Did you sit in any of the interviews with -- conducted by SLED in the car?

462:56:28

RONNIE CROSBY: I did not.

472:56:30

MR. GRIFFIN: Okay, and Lee Cope was there and he was not to be interviewed, right? That's not why he was present.

482:56:36

RONNIE CROSBY: We were there as friends to provide support and listen.

492:56:41

MR. GRIFFIN: And Mark Ball also was present.

502:56:45

RONNIE CROSBY: Mark was, and I know Mark had some meetings with law enforcement about some concerns that he had, you know, about potential suspects and safety of --

512:56:59

MR. GRIFFIN: And had -- do you recall whether you and/or Mark and Lee had given Alex some advice about whether he needed to have a lawyer at this interview?

522:57:13

RONNIE CROSBY: I don't remember that specifically. But knowing that you were already involved, I mean, any of us would have thought it was a good idea.

532:57:22

MR. GRIFFIN: Okay. Do you know whether Alex considered you and Mark and Lee, as well as Danny and Cory, you know, as his counsel that day? I mean, do you know what he was thinking?

542:57:39

RONNIE CROSBY: I don't know what he was thinking, but he never approached me as his lawyer or throughout this -- I never had the perception that I was representing him.

552:57:51

MR. GRIFFIN: Well, did you, or in your presence Mark Ball or Lee Cope, make it clear to Alex that, hey, we're not your lawyers here, and if you talk to Jim Griffin in my presence then there goes the attorney/client privilege? Did you give him that warning?

562:58:14

RONNIE CROSBY: Mr. Griffin, we're all lawyers, other than John and Buster, that were there. I don't think anybody needed to say that. It never crossed my mind that when we were sitting in a room and all of us were talking that we were somehow representing Alex.

572:58:29

MR. GRIFFIN: Well, I understand that. And -- okay, but --

582:58:32

RONNIE CROSBY: Nor would I ever do that because I don't practice in the area that you do.

592:58:40

MR. GRIFFIN: Right, but it was clear that Danny had an ongoing attorney/client relationship with Alex. Is that right?

602:58:46

RONNIE CROSBY: He did with regard to the boating accident. He was Alex's personal counsel in that.

612:58:54

MR. GRIFFIN: And Danny had sat in the initial interview in the -- that was conducted by SLED Agent Owen and Colleton County Deputy Laura Rutland on the night of June the 7th. Were you aware of that?

622:59:13

RONNIE CROSBY: Yes, I was aware of that.

632:59:15

MR. GRIFFIN: Okay, and he was representing Alex during that interview as far as you know?

642:59:20

RONNIE CROSBY: I don't know. I saw -- I mean, I know when Alex got in the car we felt like one of us ought to sit in there with him, you know, for support, because --

652:59:33

MR. GRIFFIN: Well, can you say for certain that whenever you heard conversations from Alex about his recollection of what happened on the 7th that there were any non-lawyers in the room? And I guess non-lawyers would have been Buster and John Marvin. Can you say for certain there were no non-lawyers in the room?

662:59:53

RONNIE CROSBY: That there were --

672:59:55

MR. GRIFFIN: That -- you're referring to hearing conversations with Alex in the group about what happened on the evening -- the events on the evening of June the 7th, and my question to you is when Alex was making these statements -- let me make it clear. Were there just lawyers in the room?

683:00:18

RONNIE CROSBY: I can tell you that John and Buster were there for points of time. Can I tell you who was sitting and whether John had walked out when I heard any specific thing? I can't tell you that. I couldn't catalog because, as I said, it's a little bit fluid, people coming and going, you know, law enforcement arriving outside and people walking out to greet them. It wasn't like the SLED agents just showed up and it was, you know, some rigid thing where you walked out, and there was small talk going on with the officers as well.

693:00:58

MR. GRIFFIN: Sure. Okay.

703:00:59

MR. GRIFFIN: One second, Your Honor, please.

713:01:04

(Break in proceedings.)

723:01:05

MR. GRIFFIN: That's all of the questions I have, Your Honor.

733:01:12

MR. WATERS: Nothing further, Your Honor.

743:01:16

JUDGE NEWMAN: Thank you.

753:01:18

(The witness exited the stand.)
